1. Terms of the Contract

(“you” or “End User” or “your” or “Buyer” or “Customer”) are required to read and accept all of the terms and conditions laid down herein (“Terms and Conditions” or “TERMS AND CONDITIONS” or “Terms” or “Agreement”) and the linked Privacy Policy (the “Privacy Policy”), before you may use www.azurebyszk.com (hereinafter referred to as the “Site” or “Azure” or “AZURE” or “Azure Online Store” or “we” or “our”). The Site allows you to browse, select and purchase the products available on the Site, including but not limited to gold and bespoke pieces (“Fine Jewellery”) and sterling silver pieces (“Sterling Silver Jewellery”) (Fine Jewellery and Sterling Silver Jewellery are hereinafter collectively referred to as the “Goods” or “Products” or “Services”).

These Terms and Conditions shall be effective upon your acceptance of the same and shall govern the relationship between you and AZURE a sole proprietorship having its registered address in Karachi (hereinafter the “Company”) including the sale and supply of any Products available for purchase on the Site. By placing an order for any Product(s) on this Site (“Order”) you agree to be bound by these Terms and Conditions and by continuing to access the Site, you agree to accept the practices described in these Terms and Conditions, which may be updated or changed by us from time to time, at our sole discretion.

If these Terms and Conditions conflict with any other document, these Terms and Conditions will prevail for the purposes of usage of the Site. If you do not agree to be bound by these Terms and Conditions and the Privacy Policy, you may not use the Site in any way. By placing an Order you are offering to purchase a Product on and in accordance with these Terms and Conditions. All Orders are dependent on availability of the ‘Product’ and confirmation of the price of the ‘Product’ and your acceptance of the same.

The Company may amend these Terms and Conditions and/or the Privacy Policy at any time by posting a revised version on the Site. The revised version(s) will be effective at the time we post it on the Site, and in the event you continue to use our Site post such amendments, you are impliedly agreeing to the revised Terms and Conditions and Privacy Policy expressed herein.

We reserve the right to refuse service to anyone for any reason at any time.

2. The Contract

Orders are submitted via the Site as set out in this clause.

Once you are ready to make a purchase, click on “Add to Bag” to add the Product(s) you wish to purchase to your Shopping Bag. Then proceed by clicking “Proceed to Purchase” to log into our secure servers to complete your Order. Please note this does not apply to our Fine Jewellery for which you will need to contact us in order to complete your Order. All Fine Jewellery Orders will be accepted at our sole discretion.

Once you have selected your desired Product(s), you must confirm you wish to make an Order and consent to these Terms and Conditions. You will then be asked to confirm your delivery address and input your payment details.

We will then send you a confirmation email (including your order reference number) to acknowledge that we have received your Order (“Confirmation”).  Your order will be deemed to be accepted at the time that your payment method of choice has been processed by us irrespective of whether the payment has been effected via bank transfer or debit or credit card payment. It is at this point that a legally binding contract is formed between you and AZURE for the purchase of the Product(s) (“Contract”). This acceptance will be sent to the email address that you input on the Site.

If we are unable to fulfil your Order, you will receive an email from us informing you that we are unable to fulfill your Order and we will refund the payment for your Order to you.

3. Price

When you submit your Order, you are offering to buy the Product(s) at the price set out on the Site. It is noted that the price for Fine Jewellery is an estimate on the Site. The final price will be communicated directly to you by our team upon your request.

Delivery charges (where applicable) will be added to the total amount due when you view the Product(s) in your shopping bag. The total cost for the Product(s) and any applicable delivery charges will be displayed before you confirm your Order and will be set out in the confirmatory email you receive from us. It is clarified that the price set out in the Order is exclusive of import duty, customs and other applicable taxes that may be incurred.

Our prices may change at any time. If we discover that the price for a Product has changed or that there has been a pricing error when we receive your Order, we will contact you and ask if you wish to proceed at the correct price. If you confirm that you do wish to proceed, please remember that we will not be under an obligation to supply the Product(s) until we have sent you the revised email confirming your Order at the correct price.

It is always possible that, despite our best efforts, some of the Product(s) we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the Product(s) correct price at your order date is less than our stated price at your order date, we will charge the lower amount. If the Product(s) correct price at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakable and could reasonably have been recognized by you as a mispricing, we may end the contract, refund you any sums you have paid and require the return of any Products provided to you.

4. Payment

All payments must be made at the time of confirmation of your Order. Payment for all Orders must be by credit or debit card, or any alternative payment method stipulated by us including but not limited to direct bank transfers. We accept payment via credit or debit cards including but not limited to Visa and MasterCard. If we are unable to accept or fulfil your Order for any reason then we will refund any money paid by you in respect of the Order. We will not dispatch the Product(s) until we receive payment in full.

For payment by card, all credit or debit cardholders and bank account holders respectively may be dependent on authorization and authentication by the concerned issuer / our service provider. If the issuer of your payment card or our service provider refuses to, or does not for any reason authorize or validate the payment, we will not be liable in these circumstances for any delay or non-delivery in respect of the Product(s) which you have ordered as a result.

All prices of the Products are set out in United States Dollars on the Site. Please note that if you purchase in another currency, currency fluctuations, credit card and bank service charges may make a difference to the total amount billed on your credit or debit card or in the amount transferred to us. It is agreed that such difference in payment will be absorbed by you.

5. Bespoke / Customized Orders

Please note that customized pieces including both Fine Jewellery and Sterling Silver Jewellery pieces (including but not limited to rings and bangles made to size) are made on order and can take between 4 to 8 weeks to be manufactured and delivered, but we cannot give an exact or guaranteed date and cannot be held liable for longer manufacturing and delivery times. Payment for customized pieces will be made in full at the time of the Order.

Please note only requests for bespoke Fine Jewellery pieces will be entertained and we are unable to offer bespoke services for our Sterling Silver Jewellery pieces.

6. Delivery

We aim to deliver in stock Sterling Silver Jewellery pieces to the delivery address you have requested in your Order within 3 to 10 working days from the time your Order is processed. Made to order Sterling Silver Jewellery pieces will be dispatched to you once they are manufactured, usually within 4 to 8 weeks from the time of order but we cannot give an exact or guaranteed date and cannot be held liable for longer manufacturing / delivery times. Please note that the delivery times for Fine Jewellery Orders, bespoke or otherwise, will be communicated to you directly by our team upon your request.

All deliveries made will be made vide a recorded delivery service so please ensure that someone is present at the notified delivery address to receive the Order. International delivery times may vary depending upon the destination to be delivered and the nature of the Product. Please note that we do not cover custom and duty charges applicable to international deliveries and the same will be borne by you. All delivery dates and timelines specified herein are for general guidance only. We will not be held liable for late delivery of Products.

7.  Damaged or Defective Product(s)

Except for any specific warranties we offer in relation to any particular Product(s) or consumer guarantees under law, we do not offer any warranty or guarantee on our Product(s).

You should inspect the Product(s) when you receive them for defects or damage. If you find any defect or damage contact us on inf[email protected] as soon as possible with your Order reference and in any case within 7 days from receipt of the Product. We will require the following information: proof of purchase, description of the fault, and supporting images to investigate the issue. Please note that wear and tear will not be considered as a defect. Please note that any defect or damage caused by or during delivery will not be deemed to be eligible for either refund, exchange, or repair, except for at our sole discretion.

In the case of a defect in the Product caused by repeated wear and tear, we would need to assess whether the Product is able to be repaired. We may be able to offer repair services at a charge, but this is not guaranteed and it is not guaranteed that the Product will be able to be returned to its original state. Nevertheless, we will do our best to provide the best possible outcome.

In the rare event that there is a manufacturing error in the Product, the Product must be returned to us unworn and in its original packaging, at your own risk and cost including but not limited to delivery cost. We may offer replacement, repair, or refund options, subject to the nature of the fault, availability and your preference. Please note that in case of international deliveries all customs and import duties incurred in returning the defective product to us will be incurred at your sole cost.

Please note that our Products are made with natural gemstones including but not limited to pearls so there will be slight variations amongst the gemstones used. As such, Products may vary slightly from the stock photo on the Site and will not be eligible for return on the basis of the same.

8. Exchanges and Returns

All sales are final and none of our Products including but not limited to Fine Jewellery, Sterling Silver Jewellery, Made to Order and Bespoke pieces, are eligible for exchange, refund, or return, except at our sole discretion.

9. Miscellaneous

We will update the Site to reflect that certain Products are in stock; however, you are advised to select the option to ‘notify us when in stock’ so that we may prioritize/inform you once your preferred Product is available.

As a condition of purchase, the Site requires your permission to send you administrative and promotional emails. We will send you information regarding updates about our products and promotional offers via email, SMS and/or WhatsApp messages. You can opt out of our promotional emails anytime by clicking the UNSUBSCRIBE link at the bottom of any of our email correspondences.

The Site/Company takes no responsibility for the services or products that are sold or supplied by third party vendors. The Company makes no warranty to their end users for the quality, safety, usability, or other aspect of a product or service that is supplied by a third party and/for some services or activities that involve potential bodily harm, and for those activities, the Company takes no responsibility for the service or activity being offered, and the End User takes responsibility for his or her own actions in utilizing those services.

10. Intellectual Property

The entire content of the Site, including all jewellery design, copyright, trademarks and other intellectual property rights it contains, is the sole property of AZURE and its licensors. You are not permitted to publish, manipulate, distribute or otherwise reproduce, in any format, any of the content or copies of the content supplied to you or which appears on the Site nor may you use any such content in connection with any business or commercial enterprise without prior express permission.
